Child Support Discussions

Once the decision has been made to formally separate, certain things need to be settled, especially when child is involved.

Once the new living arrangements have been decided upon, child support payments need to be settled. It’s not as easy as you might think. There are factors involved in who pays and how much. Make sure you get the right information. Your friends may think they know the answers you need but every situation is different, so getting legal help is the best plan of action but here is some information to think about.

Remember Child Support is the financial responsibility parents have for their child’s well-being. Remember the separation is not their fault. Child Support is for their benefit and that thought needs to be top-of-mind while all matters regarding Child Support are being discussed.

 

 The people that could be responsible for Child Support are:

  • Parents
  • Adoptive parents
  • Step-parents and those with a parent-like relationship NOTE: This point is murky and needs to be discussed with a lawyer.

The Family Law Act of Ontario will play a part in the determination of who may be required to pay Child Support.

 

Once determined, the amount of Child Support needs to decided. There is a Child Support table that can be found at www.justice.gc.ca. This table will show you the basic amount to be paid in Ontario. Because ChCCevery situation is different, talk to your legal professional at Angela Grant Lee Law. You will need to factor in expenses that are not the norm. (It’s better have those legally spelled out.) The Family Responsibility Office (FRO) will more than likely have to be involved if you’re the person paying Child Support.  

Child Support payments are to be paid until the child reach the age of eighteen. Parents may agree to continue the payments if the child is pursuing a post-secondary education. This will go into the Separation Agreement, which can be amended at any time. The norms regarding Child Support payments are they are paid until the child reaches eighteen, completes post-secondary education (or turns 25, whichever happens first.)

Keep in mind, that parents are obligated to financially support their children. For the good of the child, Child Support payments are enforced. If not paid, FRO can, and will, garnish your bank accounts, deduct any outstanding amounts from federal support payments, report continual non-payment to the Credit Bureau and/or have your driver’s license suspended. The amount of the payment may change over time. They could be lowered or raised as circumstances change.
