Can’t I just get an Annulment?

How Does It Work?

If your mind is thinking about an annulment as a means to end your marriage, you really need to know the definition of an annulment and how it works. According to Ontario law, an annulment can only occur if one the parties in a legal marriage can prove that the marriage isn’t valid. A Family Court Judge has to declare the marriage invalid. The short marriage you want to end has to have a good reason to sever. Annulments in Ontario fall under the AMA (Annulment of Marriages Act.) You will have to prove why you and your lawyer are taking the annulment route to dissolve the marriage instead of divorce. Most common reasons that an annulment can be granted:

·        One of the partners is legally married to someone else

·        The person applying for the annulment was very intoxicated (didn’t know what they were doing

·        One of the partners is a minor

·        Marriage took place under duress or fraud

·        One of the partners lacked mental capacity/knowledge

The most common reason for an annulment request is the marriage wasn’t consummated. This means that the couple didn’t have sexual intercourse after the legal marriage took place. If one of the parties couldn’t have sexual intercourse and didn’t share that information, that may be a reason for an annulment.

If any of the reasons noted above qualifies for proceeding with an annulment, your lawyer will present it to the Family Court Judge on your behalf.

Some people think they can marry someone for immigration purposes. You can’t marry someone for them to gain entry in to Canada. There is also something called a Religious Annulment. This is NOT done through the Courts but with your religious leader. If you receive a Religious Annulment, it’s not a legal end to the marriage. Chances are you will have to be granted a legal divorce with Family Court. No matter the reason, if you feel the marriage needs to end, call Grant Lee Law. If a Judge denies the application to have the marriage ended by annulment, a divorce proceeding will have to take place in order for the marriage to end. Some people think if they have married for days or weeks and have regrets with their choice of partner or decision to marry, they can just get an annulment and be done with that chapter of their life.
