Litigation: The Family Law Process. What To Expect When Meeting A Lawyer

Meeting with a lawyer often brings feelings of anxiousness, helplessness, and dread...but it doesn't have to!

If you have never spoken to a lawyer before, we understand that you may have plenty of questions regarding what to expect during your first meeting. It is important to note that not every lawyer will be the right fit for you, and it is important to find a lawyer with whom you feel comfortable and can trust.


The first meeting with your lawyer is the most important one. This meeting sets the stage for your case, as well as your relationship. While understandably it may be difficult to discuss your issues with an individual you have never met, your lawyer can only help you if you are willing to share your story. In the first meeting, your lawyer will ask you about your matter and the background details of your relationship. This information will include your background history with your spouse or partner, date of births, if you have children, issues relating to property, amongst other details. You should write down important dates, such as the date of marriage, the date of separation, the date of birth of any children you have, and be prepared to tell your story in a chronological order. The best way to support your lawyer is to be clear and

informative in the details of your story.


While your lawyer may not provide you with legal advice until they receive all the documents that are required, they will provide you general details on how the law may apply to your case. They will also identify your rights and obligations that stem from the relationship (i.e. child support and spousal support, parenting time, amongst others). They will also discuss the next steps that can be taken in your matter (mediation, drafting a separation agreement).


When meeting your lawyer, your role as the client is the following:

  • Make a list of questions that you have for your lawyer, no question is viewed as “unimportant”.
  • Bring your Income Tax Returns or Notice of Assessments for the prior 3 years.
  • Consider a list of assets and liabilities you and your spouse have at the date of the marriage as well as the date of separation, both jointly and separately owed.
  • Any court documents that you have been served with, such as an Application, Parenting Time Orders, or if you have drafted a Marriage Contract or Separation

Agreement with your partner.

  • Discuss your goals for your case, but understand that your goals may not be feasible or realistic once the lawyer reviews your file. Be prepared to have an

open mind when dealing with your matter.



Any information you share with your lawyer is privileged and confidential. Before meeting with your lawyer, your lawyer will want to ensure that there are no conflicts, meaning that the lawyer does not have an interest with any other party in your matter. You must bring photo identification such as your passport and driver’s license to prove your identity.
